1. Contracting party and subject of the contract
Peter Muzik New Media, in the following also called contractor/service provider, has as subject of the contract to provide services, which are in the internet marketing area.

2 Conclusion of the contract
The contract is concluded by signing and returning the original. All changes and additions to the contract must be in writing and must always be signed by both parties.

3. Principles of cooperation
The contractor reserves the right to remove orders at any time if the data to be posted on the Internet violate legal prohibitions or morality, or if their publication is unreasonable for Peter Muzik New Media. The customer has no claim for reimbursement in case of such a measure. Peter Muzik New Media assumes no responsibility for delivered data material, advertisement texts or storage media and is in particular not obligated to store them or to return them to the customer.

4 Warranty
Peter Muzik New Media will remedy technical faults, which are within his control, within a reasonable period of time. Further warranty claims are excluded. In particular, the service provider offers no warranty for information in product descriptions or specifications and is in no way responsible for malfunctions or interruptions. The service provider does not guarantee the compatibility of its services with hardware or software of the customer.

5. Data secrecy
The Contractor shall treat as confidential information and data that is not generally known and that comes to its knowledge in the course of the performance of this Agreement and that is marked accordingly by the Client. The employees of the Contractor shall be obliged to maintain data secrecy. 6 Liability
The service provider is only liable for intent and gross negligence: any further liability is excluded to the extent permitted by law. Liability for all damages (including indirect and consequential damages) due to cases of force majeure, strikes and technical failures that fall within the responsibility of other companies and / or network operators is excluded.
If liability exists, it is limited in all cases to the proven damage, but at most to the order amount. To the extent permitted by law, the service provider excludes any liability regarding the contract or any damages.
In particular, the service provider is not liable for customer content and data that is deleted due to the termination or non-renewal of a contract. Likewise, the Service Provider is not liable for illegal actions of Users towards the Customer. The customer is liable to the service provider for all disadvantages incurred by the service provider due to the violation of contractual provisions and releases the service provider from all claims of third parties, which are made to the service provider because of alleged infringement of intellectual property or other rights. Peter Muzik New Media is not liable to the client for a minimum number or minimum quality of new clients. The service provider assumes no liability for necessary residence permits and/or work permits of the client or his employees. Liability is expressly excluded.

7. Final provisions
Changes to contractual arrangements or additional agreements are only valid if they have been agreed in writing. Changes in the legal circumstances of customers do not affect the validity of the contract. The contract is binding for both parties for the entire duration of the contract. The possible invalidity of one of the above contractual provisions shall not affect the validity of the rest of the contract. The contractual relationship between the parties is subject to Swiss law. The place of performance and jurisdiction is Zurich.
